COSATU Free State welcomes the application of Section 139(b) of the Constitution at Maluti A Phofung Municipality

COSATU Free State welcomes the decision by the Free State Provincial Government to put Maluti A Phofung Municipality under administration in terms of Section 139(b) of the Constitution of South Africa. The implications of the administration are such that the Municipal Council would be left with only two powers which are to adopt the budget and to pass bylaws, however all other decisions would have to be made by the Administrator.

We are encouraged by this step from the Provincial Government albeit too late ;as a lot of damage have been done to both the workers and the community in that area by the Council led by the current Mayor who acts on impulse rather than reason and logic.

Our view is that this step takes us closer to meaningful engagements with the employer, as many meetings that have been held in trying to resolve the issues of the workers have failed

Our team of negotiators from both COSATU and SAMWU would be meeting with the administrator later today, to start with the negotiations towards resolving the issue of the workers.

We maintain that the demands of workers which include the immediate payments of third parties, equal payment for equal work for workers as well as the in sourcing of services would be very high on the agenda. The other key benefit of in-sourcing is that it will deal with fraud and corruption, which to be inherently embedded in the outsourcing of services which has bled our state resources dry.

We would continue to find a solution to the crises that was created by the Municipality, which has appointed more than 100 people during December month without following proper procedures and also duplicating the roles between the current.

As COSATU ,we are confident that our members are eager to go back to work and to deliver services to our communities ;however the deliberate obstacles that have been created by the Municipality in a form of Management and Political leadership have made it very difficult for us to serve.
